The 3D Jam will have both Open and Select categories. The Open category is open to any Entrant who fulfills the entry conditions and complies with these Official Rules. The Select category will consist of up to 10 groups of one to four Entrants, selected and notified by the Producers, who fulfill the entry conditions and comply with these Official Rules. These Official Rules apply to Entrants in both the Open and Select categories.
ELIGIBILITY: The 3D Jam is open only to participants who are 18 years of age or older at the time they submit their entry form. Entrants under the legal age of majority in their state of residence must have written permission to enter the 3D Jam from their parent or guardian.
ENTRY CONDITIONS: Entrants must have registered for, agreed to, downloaded and have the ability to operate the Leap Motion SDK available at developer.leapmotion.com. Select 3D Jam Entrants must be able to participate in the 3D Jam touchpoint sessions; Select Entrants will be notified by the Producer in advance of those times.
TIMING: The 3D Jam begins October 19, 2014 at 9:00 AM PDT, and ends on December 1, 2014 at 11:59 PM PST.
HOW TO ENTER: To enter, open 3D Jam Entrants must complete the entry form by no later than November 15, 2014 at 9:00 AM PST. Select Jam Entrants must complete the entry form by no later than October 19, 2014 at 9:00 AM PDT. No purchase or payment is necessary to enter or to win. VOID WHERE PROHIBITED.
PARTICIPATION AND FINALIST AND WINNER SELECTION: During the 3D Jam, Entrants will create and develop code for a game prototype or experience (“Game”) based on the 3D theme to be disclosed and provided on or prior November 1, 2014. Entrants who work together to submit a Game in the Open category (or submit as a single individual in the Open category), and those Entrants in the Select category selected and grouped into a team by the Producers, are referred to below as a “Team”. Only members of a Team may work on its Game. If the Producer believes, in its sole discretion, that a Team has received help from anyone who is not an Entrant belonging to that Team, the Team may be disqualified. Teams may bring code to the 3D Jam that was created by the Team prior to the 3D Jam. Games will be reviewed by a panel of jurors supplied by Producer (“Judges”). All Games submitted by each Team must be demonstrable on the Leap Motion Controller (“LMC”). If the Game is not demonstrable on the LMC, at the Judges’ discretion, then the Team submitting the Game may be disqualified. All Games submitted must be demonstrable on the Macintosh and the PC, if the Game is not operable on the Macintosh and PC, at the Judges’ discretion, then the Team submitting the Game may be disqualified. If the Game requires additional hardware (beyond the LMC, computer, keyboard/ mouse), at the Judges’ discretion we cannot guarantee it will be judged and the Team submitting the Game may be disqualified. Teams may continue to work until December 1, 2014 at 11:59 PM PST, at which time all Games must be uploaded as directed by the Producer. Between December 1, 2014 and January 10, 2015, judges from IndieCade and Leap Motion will review the submissions and select up to 20 finalists and up to 3 winners for each of the Open and Select 3D Jam categories. Judging criteria will be based 50% on Innovation (originality of the concept and mechanics), 50% on Execution (how the final experience looks and works). On or around December 20, 2014, the identity of the finalists will be announced. Winners will be announced on or around January 10, 2015. All finalists and winners will be contacted via email. If a finalist Team or Entrant is determined by the Producer to be unqualified to participate or does not respond to correspondence from the Producer within 7 days after the date it is sent by the Producer, the potential finalist or winning Team or Entrant will be disqualified and a new potential finalist or winning Team will be selected by Judges based on the judging criteria. If a potential finalist or winning Entrant is under the legal age of majority in their state of residence, any prizes will be awarded in the name of his or her parent or legal guardian.

6.4. Prize Fulfillment: Prize fulfillment is based on availability. Prizes are listed per Team, and not by Team participant or Entrant. Taxes on prize, if any, are solely the responsibility of the prize winner. Winners of a prize valued at $600 or more will receive a Federal Tax Form 1099. We recommend that you consult with your tax advisor if you have further questions. Producer reserves the right to substitute prizes of equal or greater value. Producer may disqualify a winner and select an alternate winner if any prize is returned undeliverable. Prizes are transferable among Entrants and members on the same Team. Producer need not substitute a prize based on the winner’s request.
REQUIRED DOCUMENTATION: The potential winning Entrants may be required to complete an Affidavit of Eligibility and Release (“Affidavit”) in accordance with the instructions listed in the notification correspondence. Any Entrant who fails or refuses to sign and return the required documentation within the time period as specified by Producer will be disqualified. If a potential winning Entrant is considered a minor in the legal jurisdiction in which Entrant resides, then that Entrant’s parent or legal guardian may be required to execute and return the Affidavit. Non-compliance with these Official Rules or failure to return all required documentation by the stated deadline or Producer’s inability to contact an Entrant (using the contact information provided in his or her registration) within a reasonable time period, as determined in Producer’s sole discretion, may result in disqualification and the forfeiture of prizes.
PUBLICITY: Except where prohibited, participation in the 3D Jam constitutes Entrant’s consent to Producer’s and its/their agents’ use of Entrant’s name, likeness, photograph, voice, opinions and hometown and state and any other information, including screenshots, videos or any portion of Entrant’s Game submitted to Producer by Entrant for promotional or advertising purposes, or on a winner’s list, if applicable, in any media, worldwide, in perpetuity, without further payment or compensation. Entrant’s game names or working titles are subject to Producer’s review, approval or use in connection with the 3D Jam.
GENERAL CONDITIONS: Potential winning Entrants are subject to Producer’s verification. Producer’s decisions are final and binding in all matters related to the 3D Jam. Potential winners must comply with the Official Rules, and receipt of prizes is contingent upon fulfilling all requirements. Producer is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an Entrant’s ability to participate in the 3D Jam, even if caused by Producer’s negligence. Producer has the sole discretion to modify, cancel or suspend this 3D Jam, or modify these Official Rules as necessary, should viruses, bugs, unauthorized human intervention or other causes beyond Producer’s control affect the administration, security or proper play of the 3D Jam or Producer otherwise becomes incapable of running the 3D Jam as planned or as required by applicable law. Producer is not responsible for changes to Entrant’s contact information. Any individual who attempts or otherwise encourages, directly or indirectly, the submission of false entries, as determined by Producer, will be disqualified. Producer has the sole discretion to disqualify any Entrant who tampers with the entry process. Producer has the sole discretion to disqualify Entrants who violate these Official Rules, tamper with the operation of the 3D Jam or, in Producer’s sole discretion, engage in any conduct that is deemed detrimental or unfair to Producer, the 3D Jam or any other Entrant.
USER GENERATED CONTENT: All Games must have never been previously published. Producer is not responsible for lost, late, mutilated, illegible, incomplete, postage due or misdirected entries. All entries will remain the sole property of Entrant, who may receive an opportunity to self-publish on the Leap Motion site and/or or app store. Entrants waive any claims against Producer and Promotion Entities concerning Entrant’s rights in the Game submitted under this Agreement. Producer reserves the right to reject any entries that it deems, in its sole discretion, to be inappropriate, including, but not limited to, entries including foul language, gratuitous depiction of violence or sexual behavior, or positive depictions of alcohol or tobacco. The Game must be the original, unpublished and sole work of Entrant and his or her team. Entry cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party personal or proprietary rights. Any Entrant whose work includes likeness of third parties or contains elements not owned by Entrant (such as, but not limited to, music, faces, voices, depictions of buildings, trademarks or logos) must be able to provide legal releases for such use, including a release or license for Producer to use of such elements, in a form satisfactory to Producer in its sole discretion. By participating in the 3D Jam, Entrants agree to be bound by the Official Rules. Entries not in full compliance with these Official Rules will be immediately and automatically disqualified.
RELEASE AND INDEMNITY: As a condition of participating in the 3D Jam, Entrants release and agree to indemnify Leap Motion, Inc., lndieCade d/b/a Creative Media Collaborative, Inc., and their respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all of their officers, directors, shareholders, members, employees and agents (collectively, the “Production Entities”) from all liability, claims or actions of any kind arising or alleged to arise from losses, damages or injuries to persons or property in connection with this 3D Jam, including in connection with any Games, preparation for, travel to or participation in the 3D Jam, possession, acceptance, delivery or use of prizes, participation in any 3D Jam-related activities, and claims based on publicity rights, patent, copyright or trademark infringement, defamation or invasion of privacy.
LIMITATION OF LIABILITY: Producer is not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; lost, stolen, mutilated, mis-delivered, postage due, illegible, incomplete or untimely entries that may limit Entrant’s ability to participate in the 3D Jam, even if caused by Producer’s negligence; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online system, computer equipment, servers, providers, or software, including any injury or damage to Entrant's or any other person's computer relating to participation or inability to participate in the 3D Jam; inability to access the Site or upload information or data; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, or electronic malfunction or traffic congestion on telephone lines or the Internet or any website (including the Site) or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of uploading information or data or entering information at the Site is not considered proof of delivery or receipt. Illegible, duplicate and incomplete entries will be disqualified. False, fraudulent, or deceptive entries or acts, as determined by Producer, render Entrants ineligible and all associated entries will be void.
COLLECTION OF INFORMATION: Information collected by Leap Motion in connection with the 3D Jam will be treated in accordance with Leap Motion’s privacy policy available at www.leapmotion.com. Leap Motion and IndieCade may share information collected with each other.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants or Producer in connection with this 3D Jam are governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of any other state’s laws. Entrants hereby submit to the exclusive jurisdiction and venue of the Federal and State Courts in Los Angeles and Irvine, California for the purposes of any suit related to the 3D Jam and waive any claim that they are not subject personally to the jurisdiction of said courts or that any such suit or other proceeding is brought in an inconvenient forum or improper venue.
