Leap Motion 3D Jam – Official Rules
By participating in the Leap Motion 3D Jam (“3D Jam”) each entrant (or his or her parent or legal guardian if the entrant is under the age of majority in his or her state of residence) (“Entrant”) unconditionally accepts and agrees to comply with and abide by these Official Rules, which are final and binding in all respects. Leap Motion is responsible for the collection and selection of winning entries and the overall administration of the 3D Jam.

ELIGIBILITY: The 3D Jam is open only to participants who are 18 years of age or older at the time they submit their entry form. Entrants under the legal age of majority in their state of residence must have written permission to enter the 3D Jam from their parent or guardian.

ENTRY CONDITIONS: Entrants must have registered for, agreed to, downloaded and have the ability to operate the Leap Motion SDK available at developer.leapmotion.com.

TIMING: The 3D Jam begins September 28, 2015 at 9:00 AM PDT, and ends on November 9, 2015 at 11:59:59 PM PDT.

HOW TO ENTER: To participate, 3D Jam Entrants must complete the entry form by no later than November 9, 2015 at 11:59:59 PM PDT. No purchase or payment is necessary to enter or to win. VOID WHERE PROHIBITED.

HARDWARE DISCOUNT: Upon registering for the 3D Jam, Entrants will receive an offer code that can be redeemed at leapmotion.com from July 22, 2015 at 12:01 am PDT to October 31, 2015, 11:59:59 pm PDT for a 22% discount off the regular price of the item(s). Limit 5 units of each item per order. Offer subject to credit approval. Not valid for cash or cash equivalent or toward previous purchases. Excludes duties, taxes and any import fees. May not be combined with other offers.

PARTICIPATION AND WINNER SELECTION: During the 3D Jam, Entrants will create and develop code for a game prototype or experience (“Experience”) based on one of two “Themes” – VR and Open. The VR Theme includes all augmented and virtual reality Experiences built for tethered head-mounted devices. The Open Theme includes all Experiences that do not fall within the VR Theme. Entrants who work together to submit an Experience (or submit as a single individual) are referred to below as a “Team”. Only members of a Team may work on its Experience. If Leap Motion believes, in its sole discretion, that a Team has received help from anyone who is not an Entrant belonging to that Team, the Team may be disqualified. Teams may bring code to the 3D Jam that was created by the Team or one of its members prior to the 3D Jam. Experiences will be reviewed by a panel of jurors supplied by Leap Motion (“Judges”). All Experiences submitted by each Team must be demonstrable on the Leap Motion Controller (“LMC”) and must be submitted publicly to the 3D Jam site (“Itch.io”). (Update [September 28, 2015]: Itch.io is located at at https://itch.io/jam/leapmotion3djam.) If the Experience is not demonstrable on the LMC, at the Judges’ discretion, then the Team submitting the Experience may be disqualified. All Experiences submitted must be demonstrable on Macintosh, PC, or other required operating system. If the Experience is not operable on at least one of the required operating systems, at the Judges’ discretion, then the Team submitting the Experience may be disqualified. If the Experience requires additional hardware (beyond the LMC, computer, keyboard/mouse, Oculus Rift, OSVR Hacker Dev Kit, Xbox One controller, or other forms of approved hardware), at the Judges’ discretion we cannot guarantee it will be judged and the Team submitting the Experience may be disqualified. A full list of operating systems and approved hardware will be made available by Leap Motion by September 28, 2015, and may be augmented at Leap Motion’s discretion. (Update: the list is located at https://community.leapmotion.com/t/3d-jam-approved-hardware-list/4108.) Teams may continue to work until November 9, 2015 at 11:59:59 PM PDT, at which time all Experiences must be uploaded as directed by Leap Motion. Between November 10, 2015 and December 22, 2015, members of the public will be able to rate submitted Experiences on Itch.io on a scale of 1 to 5. Between November 10, 2015 and December 22, 2015, judges from Leap Motion will review the submissions, with judging criteria based 50% on Innovation (originality of the concept and mechanics) and 50% on execution (how the final Experience looks and works). The public community scores will be factored alongside the Judges’ scores to create a combined score, consisting of 30% community vote and 70% Judges’ score. Winners will be announced on or around January 15, 2016. All winners will be contacted via email. If a winning Team or Entrant is determined by Leap Motion to be unqualified to participate or does not respond to correspondence from Leap Motion within 7 days after the date it is sent by Leap Motion, the potential winning Team or Entrant will be disqualified and a new potential winning Team will be selected by Judges based on the judging criteria. If a potential winning Entrant is under the legal age of majority in their state of residence, any prizes will be awarded in the name of his or her parent or legal guardian. Winning Teams have 60 days from the date that the winners are publicly announced to claim their prizes.

7.1.1. The first place Team for each Theme will receive $10,000 USD.

7.1.5. The fifth place Team for the VR Theme will receive $1,000 USD.

7.1.6. The two Teams with the highest scores in the community voting round in the VR Theme will receive a Community Choice prize of $500 USD.

7.1.7. The Team with the highest score in the community voting round in the Open Theme will receive a Community Choice prize of $500 USD.

7.2 Participation Prize (for final submission)

7.2.1. Any Entrants who made a hardware purchase at leapmotion.com July 22, 2015 at 12:01 am PDT to October 26, 2015, 11:59:59 pm PDT using the hardware discount code 3DJAM, and who submit a working Experience as set out in Section 6 of the Rules by November 9, 2015 at 11:59:59 PM PDT, will receive a refund of the hardware price paid. Maximum of 5 units of each item per Entrant. Does not include shipping costs, duties, taxes and any import fees. Refunds will be processed by a credit to the same payment card or account used to purchase the Leap Motion hardware. Entrants will be solely responsible for ensuring the payment card or account remains active.

7.3. Prize Fulfillment: Prize fulfillment is based on availability. Prizes are listed per Team, and not by Team participant or Entrant. Taxes on prize, if any, are solely the responsibility of the prize winner. Winners of a prize valued at $600 or more will receive a Federal Tax Form 1099. We recommend that you consult with your tax advisor if you have further questions. Leap Motion reserves the right to substitute prizes of equal or greater value. Leap Motion may disqualify a winner and select an alternate winner if any prize is returned undeliverable. Prizes are transferable among Entrants and members on the same Team. Leap Motion need not substitute a prize based on the winner’s request.

7.4. Update (September 10, 2015): Prize winners may also receive software or hardware from promotional partners.

REQUIRED DOCUMENTATION: The potential winning Entrants may be required to complete an Affidavit of Eligibility and Release (“Affidavit”) in accordance with the instructions listed in the notification correspondence. Any Entrant who fails or refuses to sign and return the required documentation within the time period as specified by Leap Motion will be disqualified. If a potential winning Entrant is considered a minor in the legal jurisdiction in which Entrant resides, then that Entrant’s parent or legal guardian may be required to execute and return the Affidavit. Non-compliance with these Official Rules or failure to return all required documentation by the stated deadline or Leap Motion’s inability to contact an Entrant (using the contact information provided in his or her registration) within a reasonable time period, as determined in Leap Motion’s sole discretion, may result in disqualification and the forfeiture of prizes.

PUBLICITY: Except where prohibited, participation in the 3D Jam constitutes Entrant’s consent to Leap Motion’s and its/their agents’ use of Entrant’s name, likeness, photograph, voice, opinions and hometown and state and any other information, including screenshots, videos or any portion of Entrant’s Experience submitted to Leap Motion by Entrant for promotional or advertising purposes, or on a winner’s list, if applicable, in any media, worldwide, in perpetuity, without further payment or compensation. Entrant further grants a license to Leap Motion to use, display and perform all or any part of Entrant’s Experience for promotional or advertising purposes, in any media or event, worldwide, in perpetuity, without further payment or compensation. Entrant’s Experience names or working titles are subject to Leap Motion’s review, approval or use in connection with the 3D Jam. Entrants are required to keep builds of their Experiences available for public download on Itch.io at no charge until December 22, 2015 in order to be eligible. Winning Teams are required to keep builds of their Experiences available for public download on Itch.io until 6 months after the winners of the 3D Jam are announced. Leap Motion, in its discretion, may offer Entrants, including winning Entrants, the opportunity to have their Experience displayed or performed at demo or other events, in which case such Entrants will be requested to reasonably update and iterate their Experiences to help ensure a high quality demonstration that performs as expected.

GENERAL CONDITIONS: Potential winning Entrants are subject to Leap Motion’s verification. Leap Motion’s decisions are final and binding in all matters related to the 3D Jam. Potential winners must comply with the Official Rules, and receipt of prizes is contingent upon fulfilling all requirements. Leap Motion is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an Entrant’s ability to participate in the 3D Jam, even if caused by Leap Motion’s negligence. Leap Motion has the sole discretion to modify, cancel or suspend this 3D Jam, or modify these Official Rules as necessary, should viruses, bugs, unauthorized human intervention or other causes beyond Leap Motion’s control affect the administration, security or proper play of the 3D Jam, or Leap Motion otherwise becomes incapable of running the 3D Jam as planned or as required by applicable law. Leap Motion is not responsible for changes to Entrant’s contact information. Any individual who attempts or otherwise encourages, directly or indirectly, the submission of false entries, as determined by Leap Motion, will be disqualified. Leap Motion has the sole discretion to disqualify any Entrant who tampers with the entry process. Leap Motion has the sole discretion to disqualify Entrants who violate these Official Rules, tamper with the operation of the 3D Jam or, in Leap Motion’s sole discretion, engage in any conduct that is deemed detrimental or unfair to Leap Motion, the 3D Jam or any other Entrant.

USER GENERATED CONTENT: All Experiences must have never been previously published; unpublished prior art is acceptable, but only if significant changes are made. Leap Motion is not responsible for lost, late, mutilated, illegible, incomplete, postage due or misdirected entries. All entries will remain the sole property of Entrant, who may receive an opportunity to self-publish on the Leap Motion site and/or app store. Entrants waive any claims against Leap Motion and Promotion Entities concerning Entrant’s rights in the Experiences submitted under this Agreement. Leap Motion reserves the right to reject any entries that it deems, in its sole discretion, to be inappropriate, including, but not limited to, entries including foul language, gratuitous depiction of violence or sexual behavior, or positive depictions of alcohol or tobacco. The Experience must be the original, unpublished and sole work of Entrant and his or her team. Entry cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party personal or proprietary rights. Any Entrant whose work includes likeness of third parties or contains elements not owned by Entrant (such as, but not limited to, music, faces, voices, depictions of buildings, trademarks or logos) must be able to provide legal releases for such use, including a release or license for Leap Motion to use of such elements, in a form satisfactory to Leap Motion in its sole discretion. By participating in the 3D Jam, Entrants agree to be bound by the Official Rules. Entries not in full compliance with these Official Rules will be immediately and automatically disqualified.

RELEASE AND INDEMNITY: As a condition of participating in the 3D Jam, Entrants release and agree to indemnify Leap Motion, Inc. and their respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all of their officers, directors, shareholders, members, employees and agents (collectively, the “Production Entities”) from all liability, claims or actions of any kind arising or alleged to arise from losses, damages or injuries to persons or property in connection with this 3D Jam, including in connection with any Experiences, preparation for, travel to or participation in the 3D Jam, possession, acceptance, delivery or use of prizes, participation in any 3D Jam-related activities, and claims based on publicity rights, patent, copyright or trademark infringement, defamation or invasion of privacy.

LIMITATION OF LIABILITY: Leap Motion is not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; lost, stolen, mutilated, mis-delivered, postage due, illegible, incomplete or untimely entries that may limit Entrant’s ability to participate in the 3D Jam, even if caused by Leap Motion’s negligence; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online system, computer equipment, servers, providers, or software, including any injury or damage to Entrant's or any other person's computer relating to participation or inability to participate in the 3D Jam; inability to access the Site or upload information or data; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, or electronic malfunction or traffic congestion on telephone lines or the Internet or any website (including the Site) or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of uploading information or data or entering information at the Site is not considered proof of delivery or receipt. Illegible, duplicate and incomplete entries will be disqualified. False, fraudulent, or deceptive entries or acts, as determined by Leap Motion, render Entrants ineligible and all associated entries will be void.

COLLECTION OF INFORMATION: Information collected by Leap Motion in connection with the 3D Jam will be treated in accordance with Leap Motion’s privacy policy available at www.leapmotion.com.

GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants or Leap Motion in connection with this 3D Jam are governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of any other state’s laws. Entrants hereby submit to the exclusive jurisdiction and venue of the Federal and State Courts in Los Angeles and Irvine, California for the purposes of any suit related to the 3D Jam and waive any claim that they are not subject personally to the jurisdiction of said courts or that any such suit or other proceeding is brought in an inconvenient forum or improper venue.
